The following are the terms and conditions for use of the Coughlans Bookshop website (“the Website”). These terms and conditions regulate the business relationship between you and us. By using the Website in any way, or by buying from us, you agree to be bound by them. No person under the age of 18 years may purchase goods. The Website is comprised of various Web pages operated by Laurence Coughlan. The Website is offered to you based on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Website constitutes your acceptance of all such terms, conditions, and notices.

  1. Contract

Your contract to purchase items from our website is considered not to be complete until you receive an email from us informing you that we have dispatched your order. That acceptance will be deemed complete and will be deemed to have been effectively communicated to you at the time Coughlans Bookshop sends the e-mail to you (whether or not you receive that e-mail).

  1. Price and Payment

It is possible that the price may have increased from that posted on our Website. If that happens, we will not send your order until you have confirmed that you wish to order at the new price. You must pay us the full price of your order before we will send any part of it.

  1. Delivery

Deliveries will be made by the courier to the address stipulated in your order. You must ensure that someone is present to accept delivery. Every care is taken in ensuring a prompt and reliable delivery of goods. Unfortunately in some circumstances completely out of our control parcels can become delayed during transit. Any dates specified for delivery are therefore approximate only. We may deliver the Goods in instalments if they are not all available at the same time for delivery.

  1. Use of Website

You agree to abide by all pertinent local, state, national and international laws and are solely accountable for all acts or omissions that occur under your use of the Website. All materials and services outlined in the Website are protected by trademark, copyright, and other intellectual property laws. All commercial use of the Services and/or Materials found on the Website is strictly prohibited without the prior written consent of Coughlansbookshop.ie.

  1. Goods Returned

When you purchase online, you have a statutory right to return the goods up to 7 days after your order has been delivered (this is the cooling off period). We can change or cancel an order up until it is dispatched. If the order has been dispatched, you can return the unopened goods to us and we will organise a refund (excluding delivery cost). Any breakages or damage must be reported within 24 hours of purchase/delivery.

  1. Limitation of Liability

To the extent permitted by law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above–mentioned damages that result from the use or inability to use the Products. Under no circumstances will our liability and that of our suppliers to you and/or third parties for any of the above exceed €150.

 

  1. Indemnity

 

You agree to indemnify us against any claim or demand, including reasonable lawyers’ fees, made by any third party due to or arising in any way out of your use of Our Web Site, your posting any Material, or the infringement by you, or by any other person using your computer, of any intellectual property or other right of any person.

  1. Content and Intellectual Property Rights

We will defend the intellectual property rights in connection with our goods and the Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, digital downloads, data, and software). We also claim copyright in the designs and compilation of all Content of Our Website. Title, ownership rights, and shall remain the sole property of us and / or the other content provider. We will strongly protect those rights in all countries. Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part. You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person.

  1. Modification of Terms

We reserve the right to change the terms of use or policies regarding the use of the Website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the terms of use on the Website.

  1. General

We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident. Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. The section titles in the terms of use are solely used for the convenience of the parties and have no legal or contractual significance.

  1. Laws

The terms of use shall be governed by and construed fully in accordance with the laws of the Republic of Ireland. You and we agree to submit to the exclusive jurisdiction of the courts located in Ireland. If any provision(s) of the terms of use is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

  1. Termination

You agree that Coughlansbookshop.ie may terminate your password, account (or any part thereof) or use of the Services or Materials, for any reason, or no reason at all. Coughlansbookshop.ie may also in its sole discretion and at any time discontinue providing the Materials, Services, or any parts thereof, with or without notice.
